Bugüne kadar, yabancı mahkeme kararlarının tenfizi davalarında alınacak harç meselesi sıkça Yargıtay'ın farklı dairelerinin inceleme ve değerlendirmesine konu olmuştur. 492 sayılı Harçlar Kanunu'nun 4. maddesi, yabancı mahkemelerce verilen ve parasal bir değere hükmedilen ilamların tenfizi davalarında nispi harç alınmasını öngörmektedir.
